1. Acceptance of Terms

By accessing and using The Express (operated by Farmers Table LLC) event management platform at https://theexpress.io, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Service Description

The Express provides comprehensive event management and RSVP collection services. We allow users to create events, collect RSVPs, manage guest lists, send invitations, track responses, share data with partners, and communicate with attendees through our platform.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials including your password. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

You may register as either a Client or Partner (Restaurant/Vendor). Your account type determines the features available to you within the platform.

4. User Content

You retain all rights to the content you submit to The Express, including event information, RSVP data, images, and communications. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, display, and transmit that content as necessary to provide our services and fulfill your requests.

You represent and warrant that you have all necessary rights to the content you submit and that your content does not violate any third-party rights or applicable laws.

5. Privacy and Data

We collect and process data as described in our Privacy Policy. We implement appropriate security measures including encryption, secure authentication, row-level security, and rate limiting to protect your data.

When you share event or RSVP data with partners through our platform, you acknowledge that those partners will have access to the shared information according to the permissions you grant.

6. Prohibited Uses

You agree not to:

  • Use the service for any illegal purpose or in violation of any applicable laws
  • Violate any local, state, national, or international law or regulation
  • Harass, abuse, threaten, or harm other users
  • Send spam, unsolicited communications, or bulk emails through our platform
  • Attempt to gain unauthorized access to our systems, networks, or user accounts
  • Interfere with or disrupt the service or servers
  • Use automated systems (bots, scrapers) without our written permission
  • Impersonate any person or entity
  • Upload viruses, malware, or malicious code
  • Collect or harvest personal data of other users without consent

7. Service Availability

We strive to keep The Express available 24/7, but we do not guarantee uninterrupted or error-free access. We reserve the right to modify, suspend, or discontinue the service (or any part thereof) at any time with or without notice. We will not be liable for any modification, suspension, or discontinuation of the service.

8. Payment and Fees

Certain features or services may require payment. You agree to provide accurate payment information and authorize us to charge the applicable fees to your chosen payment method. All fees are non-refundable unless otherwise stated or required by law.

9. Intellectual Property

The Express platform, including its software, design, trademarks, and content (excluding user content), is owned by Farmers Table LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

10. Limitation of Liability

THE EXPRESS IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FARMERS TABLE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify, defend, and hold harmless Farmers Table LLC and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the service, your violation of these Terms, or your violation of any rights of another party.

12. Termination

We reserve the right to suspend or terminate your account and access to the service at any time, with or without cause, with or without notice. Upon termination, your right to use the service will immediately cease. You may terminate your account at any time by contacting us.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the service shall be resolved in the courts located in San Francisco County, California.

14. Changes to Terms

We may update these terms from time to time. We will notify users of significant changes via email or through a notice on the platform. The "Last updated" date at the top of this page indicates when the Terms were last revised. Continued use of the service after changes constitutes acceptance of the updated terms.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
